iPride Portal Mobile Application

1. Acceptance of Terms

Welcome to International Pride Softball’s iPride Portal mobile application (the “App”). These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and the North American Gay Amateur Athletic Alliance, doing business as International Pride Softball (“iPride Softball,” “we,” “us,” or “our”).

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App.

 

2. About iPride Softball and Our Mission

International Pride Softball fosters an inclusive, equitable, and affirming space where LGBTQIA2S+ individuals of all identities can connect, compete, and thrive. Through sport, we build resilient communities, celebrate diversity, and honor the rich heritage of LGBTQIA2S+ athletes on and off the field.

 

3. Eligibility and Account Registration

3.1 Age Requirements

You must be at least 18 years old to use this App. By using the App, you represent and warrant that you meet this age requirement.

 

3.2 Account Creation

• You must provide accurate, complete, and current information during registration
• You are responsible for maintaining the confidentiality of your account credentials
• You agree to notify us immediately of any unauthorized use of your account
• You may only create one account per person

 

3.3 Account Verification

We may require verification of your identity or eligibility to participate in certain leagues or tournaments.

 

4. Acceptable Use Policy

4.1 Community Standards

iPride Softball is committed to maintaining a safe, inclusive environment. You agree to:

• Treat all community members with respect and dignity
• Use inclusive language and respect preferred pronouns
• Support an environment free from discrimination, harassment, or hate speech
• Promote good sportsmanship and fair play
• Follow all applicable league rules and regulations

 

4.2 Prohibited Conduct

You agree NOT to:

• Engage in discriminatory behavior based on sexual orientation, gender identity, race, religion, or other protected characteristics
• Harass, bully, intimidate, or threaten other users
• Post or share inappropriate, offensive, or explicit content
• Use the App for commercial purposes without authorization
• Impersonate others or create fake profiles
• Violate any applicable laws or regulations
• Interfere with the App’s functionality or security
• Share false or misleading information about games, scores, or statistics

 

4.3 Content Guidelines

All content you post or share must:

• Be respectful and appropriate for all ages
• Not contain personal information of others without consent
• Not infringe on intellectual property rights
• Comply with applicable privacy laws

 

5. User-Generated Content

5.1 Content Ownership

You retain ownership of content you create and post through the App. However, by posting content, you grant iPride Softball a non-exclusive, royalty-free, worldwide license to use, display, and distribute such content in connection with the App and our services.

 

5.2 Content Responsibility

You are solely responsible for the content you post and represent that:

• You have the right to post such content
• The content does not violate these Terms or applicable laws
• The content is accurate and not misleading

 

5.3 Content Moderation

We reserve the right to review, edit, or remove any content that violates these Terms or our community standards, but we are not obligated to do so.

 

6. League and Tournament Participation

6.1 Registration and Fees

• All league and tournament registrations are subject to applicable fees
• Registration fees are non-refundable unless specifically stated otherwise
• Payment must be completed before participation is confirmed
• We reserve the right to modify fees with reasonable notice

 

6.2 Eligibility Requirements

• Players must meet specific league eligibility requirements
• Participation may be subject to skill level assessments
• Team rosters must comply with league composition rules
• Players may be required to provide proof of eligibility

 

6.3 Competition Rules

• All participants must follow iPride Softball rules and regulations
• Disputes will be resolved according to established procedures
• Disciplinary actions may result in suspension or expulsion
• Tournament brackets and schedules are subject to change

 

6.4 Player Safety

• Participation in softball activities involves inherent risks
• Players participate at their own risk
• We recommend appropriate insurance coverage
• Report any safety concerns or incidents immediately

 

7. Payment Terms

7.1 Fees and Charges

• All fees are clearly displayed before payment
• Prices are subject to change with reasonable notice
• Additional charges may apply for premium features or services
• All payments are processed through secure third-party providers

 

7.2 Refund Policy

• Registration fees are generally non-refundable
• Refunds may be considered for extraordinary circumstances
• Refund requests must be submitted in writing
• Processing time for approved refunds is 5-10 business days

 

7.3 Payment Processing

• We use secure, PCI-compliant payment processor
• You authorize us to charge your payment method for applicable fees
• Failed payments may result in service suspension
• You are responsible for keeping payment information current

 

8. Intellectual Property Rights

8.1 iPride Softball Property

The App and all content, features, and functionality are owned by iPride Softball and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.

 

8.2 Trademarks

“International Pride Softball,” “iPride,” “iPride Softball,” and related logos are trademarks of iPride Softball. You may not use these marks without express written permission.

 

8.3 DMCA Compliance

We respond to valid copyright infringement claims. If you believe your copyrighted work has been infringed, please contact us with the required information under the Digital Millennium Copyright Act.

 

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices.

 

10. Disclaimers and Limitations

10.1 Service Availability

• The App is provided “as is” and “as available”
• We do not guarantee uninterrupted or error-free service
• We may suspend or modify the App for maintenance or updates
• Third-party services may affect App functionality

 

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, iPRIDE SOFTBALL SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA LOSS, OR PERSONAL INJURY.

 

10.3 Assumption of Risk

By participating in softball activities organized through the App, you acknowledge and assume the risks inherent in such activities, including but not limited to the risk of injury.

 

11. Indemnification

You agree to indemnify and hold harmless iPride Softball, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the App
• Your violation of these Terms
• Your participation in softball activities
• Any content you post or share through the App

 

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of [State/Province], without regard to conflict of law principles.

 

12.2 Dispute Resolution Process

1. Direct Communication: First attempt to resolve disputes through direct communication
2. Mediation: If direct communication fails, disputes will be submitted to mediation

12.3 Venue

• Your access to the App will cease immediately

• You remain liable for any outstanding fees or obligations
• Sections of these Terms that should survive termination will remain in effect

 

14. Modifications to Terms

We may modify these Terms at any time to reflect changes in our services, legal requirements, or business practices. We will notify you of material changes through:

Your continued use of the App after such changes constitutes acceptance of the modified Terms.

We will not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, or public health emergencies.

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

 

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and iPride Softball regarding your use of the App.
